Terms of Service

Welcome to the Somia ecosystem. These Terms of Service govern access to and use of our applications, devices, certified integrations and any digital service offered by Yeshcube Tech, S. L. (hereinafter "Yeshcube", "Somia", "we").

By using Somia you accept these Terms of Service and acknowledge that you have read our Privacy Policy.

If you do not accept these terms, you must not use Somia or its associated services.

2. Nature of the service

Somia is an emotional wellbeing ecosystem based on:

• digital applications and platforms
• sensory and conversational experiences
• conversational artificial intelligence
• proprietary devices and third party devices certified as Somia Within
• embedded systems in corporate, home or public spaces

Somia is not a healthcare service, it is not therapy, it is not a medical diagnosis and it does not replace professional mental health care.

Somia must also not be used in life threatening situations or emotional crises. In such cases, you must contact emergency services (for example 112 in Europe) or helplines in your country.

3. Eligibility conditions

To use Somia you must:

• be at least 16 years old, or the minimum age required by the law of your country
• have the legal capacity to accept these Terms
• provide accurate and up to date information during registration
• not use Somia in a way that is contrary to the law, the purpose of the service or these Terms

Yeshcube reserves the right to restrict or cancel accounts that breach these conditions.

4. User account

4.1 Registration and authentication

To create an account you must provide an email address and password, and accept that:

• you are interacting with an artificial intelligence system, not with a human

Somia does not replace healthcare

• it must not be used in crises
• you accept the Privacy Policy and these Terms of Service

We reserve the right to reject fraudulent or unauthorized registrations.

4.2 Account security

You are responsible for:

• keeping your password secure
• not sharing your credentials with third parties
• notifying us if you detect suspicious activity

We reserve the right to temporarily block your account if we detect anomalous activity or a security risk.

5. Acceptable use of the Somia ecosystem

You are prohibited from using Somia for:

• illegal or harmful activities, or activities contrary to the emotional wellbeing purpose of the service
• attempting to tamper with, copy, decompile, or gain unauthorized access to our systems
• falsifying your identity or impersonating another person
• training external models using content generated within Somia, unless expressly authorized
• using Somia to collect data from other users

We may suspend or cancel your account if you breach these rules.

6. Artificial intelligence and technical operation

6.1 Interaction with AI

Somia's interactive experiences are based on conversational artificial intelligence. This means that:

• responses may contain errors or inaccurate interpretations
• the system may generate memories or recommendations that are not always applicable to your context
• you must use your own judgement and not make sensitive decisions based solely on Somia

6.2 Voice provider

Somia uses technology from a specialized voice AI partner, such as ElevenLabs, to enable natural conversations. Your voice is processed in real time during the conversation exclusively in order to provide you with the interactive experience.

6.3 Additional AI models

Some features may use third party AI models that can perform:

• text analysis
• pattern extraction
• generation of ultra concise memories
• automatic adjustment of recommendations

6.4 Crisis detection

Somia includes automated mechanisms to detect possible signs of emotional crisis. You should bear in mind that:

• the system does not detect every crisis
• it may generate false positives and false negatives
• it does not replace professional care
• it does not send alerts to third parties or emergency services
• its role is purely informative

In the event of an actual crisis, you must contact medical or emergency services.

7. Memory, personalization and storage

7.1 Memory system

Somia includes a memory system to adapt the experience. The system:

• is activated only with your consent
• works with categories that you choose
• generates short "memories" based on your conversations
• allows you to delete memories or deactivate categories at any time
• can operate only on your device (local first)

7.2 Local and cloud storage

Somia stores data mainly:

• locally on your device, to maximize your privacy
• optionally in the cloud, if you enable backup

8. Subscriptions and plans

Somia may offer:

• free plans
• premium plans
• professional licenses
• corporate or institutional licenses

By subscribing you accept the current prices and conditions of the chosen plan, the monthly usage limits, and that certain limits may temporarily block features until you free up space or upgrade your plan.

8.1 Payments and renewals

Payments are processed through external providers. By purchasing a plan:

• you authorize the corresponding recurring charges
• renewals are generally automatic
• you can cancel your subscription at any time from your profile

Cancellations apply to future billing periods and are not applied retroactively.

9. User content

Any content you transmit in conversations with Somia remains yours. However, in order to operate the service, you grant us a limited license to:

• process that content
• generate memories and personalizations
• maintain, improve and provide Somia's features
• comply with technical or legal obligations

This license is non exclusive, revocable and limited to the operation of the service. We do not use your content for external commercial purposes.

10. Intellectual property rules

All content in Somia is protected by intellectual and industrial property rights owned by Yeshcube Tech, S. L. or our partners.

You are prohibited from:

• copying or reproducing in any form substantial parts of Somia
• reproducing models, databases or systems
• creating derivative works without authorization
• using Somia to train external systems without our express written permission

11. Limitations of liability

Somia is provided "as is", without guarantees of accuracy, uninterrupted availability, usefulness for specific objectives or suitability for clinical purposes.

11.1 No liability for decisions made with the app

Yeshcube is not liable for:

• personal decisions made on the basis of conversations with Somia
• misinterpretations of recommendations generated by AI
• failure to detect crises
• outcomes resulting from errors, interruptions or technological inaccuracies

11.2 No healthcare liability

Somia does not replace medical or psychological care. We are not liable for damage caused by:

• relying on Somia instead of seeking professional care
• using Somia during crises
• failing to contact emergency services when needed

11.3 Interruptions or technical failures

We are not liable for:

• failures in networks, AI providers, storage or servers
• loss of local data on your device
• issues arising from technical limitations of Bluetooth or audio
• interruptions caused by maintenance or updates

12. Suspension or cancellation of the service

We may suspend or cancel your account if:

• you breach these Terms
• you engage in fraudulent or abusive use of the service
• it is necessary to protect the integrity of the system or other users
• this is required by law

If we cancel your account, you will be notified unless prohibited by law.

13. Account and data deletion

You can delete your account from your profile settings or by requesting it by email. When you delete your account:

• your data stored in the cloud is permanently deleted
• local memories remain on your device until you delete them manually
• we cannot recover deleted information
• deletion does not affect data we must retain due to legal obligations

14. International transfers

Using Somia may involve data transfers to providers operating global infrastructures. These transfers are carried out with appropriate legal safeguards, standard contractual clauses where applicable, and additional technical security measures. You can find more information in our Privacy Policy.

15. Governing law and jurisdiction

These Terms are governed by Spanish law, without prejudice to any rights you may have under the law of your country of residence. Any disputes will be submitted to the courts of Valencia (Spain), unless otherwise provided by law.

16. Amendments to the Terms

We may amend these Terms of Service in order to:

• adapt them to legal changes
• evolve the Somia ecosystem
• improve security, the user experience or the clarity of the document

If the changes are substantial, we will notify you and you may decide whether to continue using Somia.

17. Bloom-specific conditions

In addition to all previous clauses, for Somia Bloom services at https://bloom.somia.io:

• you must ensure the physical environment where Bloom is used is safe before each session
• you must not use Bloom while driving, operating machinery, or performing tasks requiring full situational awareness
• when Bloom is deployed in shared pods, cabins, corporate, hospitality, educational or public spaces, the operator must display visible notices about AI interaction and emergency limitations
• when your plan includes installation or on-site configuration services, you are responsible for providing technical access windows, power/network readiness and lawful permissions to enter the space

18. Pilot-specific conditions at the Universitat de València Science Park

In addition to all previous clauses, for the Somia Bloom pilot at https://pcuv.somia.io:

• the account is created with an email address and a password, without having to confirm the email; you will receive a welcome email
• in “My area” you can manage your appointments, see your experiences, review and correct what Somia remembers, switch memory off, change your password, download your data and delete the account
• memory runs on our server, only with your permission, and not on your device; what sections 7.2 and 13 say about local storage does not apply to the pilot
• visit bookings use a single calendar, and an appointment is not confirmed until the team confirms it
• if you book without signing in using the email of a pilot account, the appointment is added to that account
• details of data processing in the pilot are in section 16 of the Privacy Policy
